Legislation sponsored by Senate President John O. Bennett (R-12) that would protect the financial future of minor children whose parents die without a will was recently approved by the full Senate.
Under the bill, the parent or guardian of a victim’s minor child or other minor beneficiary could apply to the court for permission to place funds from the victim’s estate into a trust that would authorize delayed distribution of the funds.
Bennett originally drafted the measure with the surviving children of the Sept. 11 victims in mind, and later amended it to include all minor children whose parents die without a will.
