MARLBORO — The driver of a vehicle that struck two pedestrians on Route 9, killing one, has been charged with a motor vehicle violation by police.
The surviving pedestrian has also been charged with violating a state statute.
Marlboro police Sgt. Joseph M. Lenge said Christina Soubasis, 28, of Freehold, has been charged with careless driving. Although police have no doubt that weather played a role in the March 6 accident, they maintain it is the responsibility of the driver "to drive with due caution."
Police previously said the accident occurred during a period when the weather unexpectedly resulted in icy roads. The accident occurred at about 10:57 a.m.
Hanna Yavorska, 42, of Marlboro, one of the two pedestrians struck by Soubasis’ car, was charged with failure to walk against traffic. According to a state statute, "on all highways where there are no sidewalks or paths provided for pedestrian use, pedestrians shall, when practicable, walk only on the extreme left side of the roadways or its shoulder, facing approaching traffic."
Yavorska was transported to Jersey Shore Medical Center, Neptune, in critical condition after the accident. She remained in the hospital on Monday in satisfactory condition.
Olga Vakarechuk, 46, of Marlboro, who was walking with Yavorska, was pronounced dead at the scene of the accident.
The women were walking near the driveway of Nonna’s restaurant, when the accident occurred. Police believe Sou-basis, who was driving north, lost control of her vehicle before striking the women.
