Candidate’s eligibility questioned

Twin Rivers Homeowners Association board of directors candidate Al Wally said incumbent candidate Rob Moore should not be allowed to run in the election.

   EAST WINDSOR — Al Wally, candidate for the Twin Rivers Homeowners Association board of directors, questioned the eligibility of another candidate Wednesday, when he announced that candidate Rob Moore is not considered a "member in good standing" of the association.
   He said during a meeting of the board that because Mr. Moore is not the named owner of his home, he cannot be a member in good standing. Mr. Wally said that because one must be a member in good standing to run in the election, Mr. Moore should not be allowed to run.
   According to Twin Rivers’ articles of incorporation, to be a member of the association, one must be the "record owner… in any lot or living unit" in Twin Rivers.
   According to township tax records, Mr. Moore’s home is owned by his wife, Theresa.
   Mr. Wally then referenced a resolution that states, "candidates for election to the board of directors… must be members in good standing."
   In order to qualify as a "member in good standing," one must be up-to-date in paying his association fees.
   Board President Scott Pohl did not argue the wording of the resolution, but added that the bylaws state that directors do not have to be members of the association.
   "You don’t even have to be a resident," he said.
   Following the meeting, Mr. Pohl explained, "If a candidate happens to be a member, then he must be a member in good standing."
   "You have to remember that we are dealing with 30-year-old documents," he continued. "I would like to change some of them myself someday."
   Mr. Moore has served on the board of directors for one year. He was appointed to fill the seat vacated by the resignation of Robert Hudak.
   Twin Rivers will hold its election Thursday at 8 p.m. in the Community Room.
