Stockton resident Philip Matlack, 54, was charged with possession of marijuana in the township municipal courtroom at approximately 7:30 p.m. March 20.
A police officer noticed a dried brown vegetative matter rolled into a white cigarette on the end of the bench seats in the fifth row in the courtroom. He suspected it was marijuana. The bench was empty and 30 people were in the courtroom waiting for their cases to be heard.
He and another police officer who had been on duty in the courtroom remembered that Mr. Matlack was the only person who had been sitting in that area. Mr. Matlack had moved after talking to the prosecutor about a traffic violation. He was still in the courtroom waiting to enter a plea.
The police officers asked him to step outside. They showed him the cigarette and asked if it was his. He said no initially. Later, he said he had forgotten he had it and that it must have fallen out of his pocket when he put his eyeglasses on.
Police escorted Mr. Matlack back into the courtroom where he remained until his case was heard. Police, then charged him with possession of less than 50 grams of marijuana. He was given a court date and released.
