Rosario DiGirolamo labeled a person of interest in the disappearance of his mistress, Amy Giordano, of Hightstown will stand trial on charges of abandoning the couple’s toddler boy outside a Delaware hospital.
Mr. DiGirolamo, 32, of Millstone, was scheduled for a preliminary hearing this Friday but he will waive that hearing, according to a spokeswoman at the office of his Trenton lawyer, Jerome Ballarotto.
Jason Miller of the Delaware Attorney General’s Office confirmed that Mr. Ballarotto filed paperwork Tuesday to waive the hearing, which means Mr. DiGirolamo will stand trial.
He faces a maximum prison sentence of five years on a felony charge of reckless endangering and a maximum one-year term on a misdemeanor charge of child abandonment, Mr. Miller previously explained.
Ms. Giordano, 27, was last seen June 7 at the ShopRite store in East Windsor. That was two days before her son with Mr. DiGirolamo, Michael DiGirolamo, was found outside the Christiana Hospital in Newark, Del. And five days later, June 14, Mr. DiGirolamo flew to Italy.
He returned Aug. 2 to face the child abandonment charges. He has not been charged in connection with Ms. Giordano’s disappearance.
