MANVILLE: Tavern’s council hearing postponed

   MANVILLE — A Borough Council hearing scheduled for today (Monday) on charges brought against Uncle Davey’s Tavern owner Dave Kiernan is being postponed for a second time because a planned municipal court hearing Nov. 13 was also postponed.
   The Borough Council will consider a resolution at today’s meeting to grant an adjournment for the hearing.
   The hearing was initially scheduled for Nov. 10, but Mr. Kiernan’s attorney requested it to be postponed until after the hearing on the charges in municipal court.
   According to Borough Administrator Gary Garwacke, a postponement for the municipal court hearing was requested, and the Borough Council cannot hold its hearing until after the other takes place.
   On Oct. 13, the Borough Council approved six violations against Mr. Kiernan, all stemming from incidents in August when he allegedly assaulted two patrons. If found guilty of the charges, Mr. Kiernan faces a 285-day liquor license suspension.
   Two charges allege Mr. Kiernan assaulted a female patron by carrying her against her will over his shoulder to an area outside the bar, dropping her on her face in a gravel area and putting her in a chokehold. A third charge alleges he allowed for the sale of alcoholic beverages on the premises to an apparently intoxicated patron, while a fourth alleges he sold the alcohol to an underage customer.
   The last two charges allege Mr. Kiernan committed, and allowed for, the assault of a male patron by putting him in a chokehold and spraying his face with mace.
   If he is found guilty of the charges, Mr. Kiernan will have the opportunity to appeal the decision.
   Currently, Mr. Kiernan’s tavern is open during the appeal of a 390-day liquor license suspension stemming from the council finding him guilty in February of nine liquor law violations.
