TRENTON – A Mercer County grand jury Friday returned an indictment charging Rosario DiGirolamo with the murder of Amy Giordano, of Hightstown, Mercer County Prosecutor Joseph L. Bocchini Jr. announced.
Mr. DiGirolamo 34, of Brooklyn, N.Y., and formerly of Millstone, was charged in a two-count indictment with first-degree murder and fourth-degree tampering with evidence, according to a release issued by the prosecutor’s office. If convicted, he could face a maximum sentence of life in prison.
The indictment charges Mr. DiGirolamo with killing Ms. Giordano between June 7 and June 9, 2007.
Mr. DiGirolamo was taken into custody at his parents’ home on East 2nd Street in Brooklyn by members of the U.S. Marshals Service New York/New Jersey Regional Fugitive Task Force, Trenton and New York Divisions on March 20, 2008, after a 10-month investigation.
Also named in the indictment is John A. Russo Jr., 44, of Staten Island, N.Y. Mr. Russo is charged with one count of fourth-degree tampering with evidence. If convicted, Mr. Russo could face a maximum sentence of 18 months in prison.
Mr. DiGirolamo was released from the Mercer County Correction Center on Nov. 26, 2008, after posting a $1 million bond. His next court appearance will be an arraignment. No date has been scheduled.
Mr. Bocchini credited Detective James Francis of the Mercer County Prosecutor’s Homicide Unit, Detective Michael Rosica of the New Jersey State Police, Detective Benjamin Miller of the Hightstown Police Department and Detective Jose Gonclaves of the Monmouth County Prosecutor’s Office with the investigation leading to Mr. DiGirolamo’s arrest and indictment.
Assistant Prosecutor Tom Meidt, chief of the Homicide Unit, presented the case to the grand jury.
