In the article “Council brokers driveway solution” (Packet 2/20/09) there are a number of points that need to be clarified regarding the recent release of bonds for the Village Grande development.
First, it should be noted that the builder is legally required to correct issues such as raised aprons under the maintenance guarantee which covers these types of problems for a period of two years.
Second, the Township Engineer verified the aprons identified by the Homeowners’ engineering consultant and also generated a list of additional issues that needed to be addressed by the builder.
The maintenance guarantee that is required by law after the performance bonds are released will cover any future maintenance required for the two year period. This is required and not negotiable. The Township Engineer and Township Attorney did negotiate an additional $70,000 in cash above the required 15 percent maintenance guarantee to cover the correction of known problems, like the aprons and sidewalks, this spring as opposed to two years from now.
The Community Development Department will continue to work with the residents of Village Grande to address their concerns and to implement the plan authorized by the Mayor and Township Council.
