A charge of endangering the welfare of a child against a Montgomery man was dropped after the Somerset County grand jury was unable to find sufficient evidence for an indictment.
Benjamin Capan, 40, of Hastings Road in Belle Mead was charged earlier this year with the offense.
Jan. 5, police had received information regarding a possible criminal sexual contact from the parent of a juvenile, according to county Prosecutor Wayne Forrest. In an interview with authorities, the juvenile indicated the abuse took place while at Mr. Capan’s residence, Mr. Forrest stated.
As a result of the grand jury’s decision, criminal prosecution cannot be pursued, and the case is closed.
