Owner of restaurant pleads guilty

The owner of a Manalapan restaurant admitted on June 9 to subscribing to false corporate and personal federal tax returns, U.S. Attorney Paul J. Fishman announced.

Michael Logan, 44, of Jackson, pleaded guilty before U.S. District Judge Anne E. Thompson, sitting in Trenton, to all nine counts of an indictment charging him with making and subscribing to federal tax returns to the IRS that he did not believe to be true and correct as to every material matter.

Counts one through five relate to 2004 through 2007 corporate returns filed for Logan’s restaurant, Michael’s Cucina Italia, of Manalapan. Counts six through nine relate to personal tax returns filed by Logan.

At his plea hearing, Logan admitted that he was the owner and operator of ITI Inc. doing business as Michael’s Cucina Italia, and that he underreported his gross receipts and sales: on his 2004, 2005 and 2006 corporate income tax returns; his 2007 corporate income tax return and partnership income tax return; and his 2004, 2005, 2006 and 2007 personal income tax returns.

According to a press release, the charges to which Logan pleaded guilty each carry a maximum potential penalty of three years in prison and a $100,000 fine. In addition, Logan has agreed to pay $158,245 in restitution to the IRS for all losses resulting from the offense. Sentencing is currently scheduled for Oct. 3.

Fishman credited IRS–Criminal Investigation, under the direction of Victor W. Lessoff, with the investigation leading to Logan’s guilty plea.
