A Roebling man must have no contact with a special needs teenaged girl he repeatedly had sexual contact with in Princeton and meet other conditions to be allowed into a diversionary program for first-time offenders.
Brian C. Dornbach, a 51-year-old unemployed bachelor, was admitted to the pre-trial intervention program for 36 months on Monday. Superior Court Judge Robert C. Billmeier, sitting in Trenton, read out the conditions from the bench during Mr. Dornbach’s court appearance in the morning.
In addition to having no contact with the victim, he also is not allowed to have unsupervised contact with children under the age of 18, must get sex offender specific counseling and undergo an evaluation to determine if he has substance dependency. He also must do 40 hours of community service and pay $125 in fines.
Mr. Dornbach spoke only to answer the judge’s questions. He said he is supporting himself by collecting unemployment.
His lawyer, John W. Hartmann, told the judge that Mr. Dornbach lost his job as manager at the Princeton Record Exchange as a result of the criminal allegations.
He, however, will need to find a job, the judge said.
Mr. Dornbach did not have to admit to the charges, which will go away if he successfully completes the program.
The victim was not in the courtroom Monday. She and her family are in agreement with the how the case is being resolved, authorities said. Assistant Mercer County Prosecutor John Carbonara, speaking outside the courtroom, said it was a “fair resolution” to the case.
Mr. Dornbach, arrested Jan.8, 2013, was charged with aggravated sexual contact and endangering the welfare of a child. Princeton police alleged that between January 2011 and December 2012, Mr. Dornbach committed multiple acts of criminal sexual contact on the girl, whose father was known to Mr. Dornbach. She was 16, police said.
The matter came to light when the victim told a gym teacher what had happened, said the Mercer County Prosecutor’s Office. In turn, the victim’s father reported it to the Denville police, who in turn contacted Princeton Police.
In June, he was indicted on eight counts of fourth-degree criminal sexual contact and one count of third-degree endangering the welfare of a child.
Mr. Carbonara said the girl’s family thinks she has moved past the ordeal and did not want to have her go through a trial. He offered, however, that the girl was not refusing to testify.
