Spotswood adopts ordinance enforcing permit requirements for garage sales

SPOTSWOOD–For residents who plan on having a lawn sale, the Borough Council adopted an ordinance amending the municipal code to add new garage sale sign and permit requirements.

Garage sales include any lawn sale, attic sale, rummage
sale or flea market or any similar casual sale of used tangible personal property
in a residential area of the borough which his advertised by any means whereby the
public at large is or can be made aware of such sale, according to the council.

Any person desiring to conduct a garage sale will first notify the borough clerk, no
later than one week before the date of such sale, and will provide the
following information:

  • name of the person conducting the sale
  • location or address at which sale is to be conducted
  • date of sale
  • the number of days of sale

The council approved and adopted the ordinance adding new garage sale sign and permit requirements on July 13 during the council meeting via video conference.

Only one garage sale will be conducted during any month. Permit owners must be present on-site during the hours of the sale. The permit will be prominently posted on site, according to the council.

No person can have more than five garage sales on his premises in any one calendar year, according to the council.

No person can conduct any garage sales without having first obtained a permit from the borough clerk and paying the fee, which will be $7.50 per sale. Multifamily sales are not allowed. Only sales by the owners of the house may take place, according to the council.

No more than five signs advertising a sale may be posted in the borough. The size of signs should be no larger than 1 foot by 2 feet and will not be posted earlier than one week prior to sale. All signs must be removed by the day after the sale, according to the council.

No sales will be conducted in a non-residential area/zone. Parking enforcement of certain designated streets/roadways will not be suspended for any sale, according to the council.

In the event of a declaration of a public health emergency crisis in the state, any rules and regulations adopted by either the state legislature or executive order from the state regulating garage sales will be binding, according to the council.
