Portion of litigation over Montgomery High construction is settled

   MONTGOMERY — The Montgomery Township Board of Education has reached a settlement with three companies regarding the roof aspect of litigation over the construction of Montgomery High School.
   The litigation was initiated by the project’s mechanical contractor, which filed a complaint against the school board and other parties in February 2006.
   The settlement, which the school board approved at its April 8 meeting, is with Noble Roofing and Sheet Metal Inc., Thomas P. Carney Inc. and Versico LLC.
   Under the settlement, Noble will perform all repairs to the high school roof to the satisfaction of Versico, which had canceled the school district’s warrantee because it was unsatisfied with the materials used to repair the roof by another party hired by the school board.
   Versico would then reinstate the warranty and the school board would pay Noble $23,000 and dismiss claims it had made against Versico. As part of the settlement, Carney agreed to allow the school board to use some of the money it has claimed the school board owes it to pay Noble, according to the school district’s business administrator, Tom Venanzi.
   The roofing issue is “a small portion” of the litigation between the board and the mechanical contractor Donald C. Rodner, according to Mr. Venanzi.
