A vote on the Insurance Auto Auctions application has been pushed to a future meeting of the Marlboro Zoning Board of Adjustment.
At the board’s Jan. 28 meeting, attorney Sal Alfieri, who represents Insurance Auto Auctions, said his client has amended its application. The public hearing on the proposal is expected to continue on Feb. 11.
The applicant initially proposed to expand a pre-existing, nonconforming use at 426 Texas Road, Marlboro, where the company has stored and auctioned damaged vehicles since 1988. Insurance Auto Auctions’ representatives are not heavily altering the application, Alfieri said.
“It’s just that because there were so many meetings and the application was modified during the course of the testimony — reducing the request for the hours of operation, changing some of the access points and clarifying the history of the properties — everyone felt it would be best if we amended it to just outline exactly what we are asking for,” Alfieri said.
The applicant now seeks approval to operate on Saturday, and from 5:30-7 p.m. Monday through Friday, Alfieri said. Company officials initially hoped to work on the site earlier in the morning and later into the evening.
Attorneys representing neighboring objectors have said the application should include a request for a use variance. Alfieri and his client have disputed that idea.
Insurance Auto Auctions’ representatives plan to file new documents and submit additional testimony to the board, Alfieri said.
Board members and professionals, the objectors’ lawyers and members of the public will have the chance to speak about the new material.
One objector claimed that Insurance Auto Auctions has committed zoning violations on the site. Marlboro’s zoning officer confirmed that the business received a notice of violation in the past.
